Ashley St. Clair is suing Elon Musk for custody of his alleged 13th child, alleging he wanted to have another baby with her.
Ashley St. Clair, a 26-year-old woman, has filed a lawsuit against Elon Musk, the CEO of SpaceX and Tesla.
In her legal action, she seeks to establish paternity for her newborn son, whom she claims is Musk’s alleged 13th child.
This lawsuit also includes a request for sole legal custody of the child.
St. Clair claims Elon Musk is her child’s father.
According to court documents, St. Clair began dating Musk in May 2023.
She alleges that they had intimate relations around the beginning of January 2024, specifically on January 2 and 3.
St. Clair believes this is when her son was conceived.
The details of the child’s birth have been kept private, but it is known that his name starts with the letter “R.”
In her filing, St. Clair expressed confidence that Musk is the father.
She noted that during the time of conception, she did not have sexual relations with any other man.
To support her claim, she has asked the court to mandate genetic testing for Musk to confirm paternity.
St. Clair has provided text messages between herself and Musk to support her claims.
In one exchange, she sent Musk a photo of her holding their baby in the hospital.
Musk allegedly replied, expressing eagerness to meet her and their child.
“I look forward to seeing you and him this weekend,” the messages read.
In another message from November 2024, Musk reportedly said, “I want to knock you up again,” and he repeated similar sentiments in February 2025.
“Well, we do have a legion of kids to make.”
These messages have raised eyebrows and added to the public interest in the case.
The two have also exchanged flirtatious texts that suggest a close relationship, which St. Clair hopes will help her case in court.

In her lawsuit, St. Clair is not asking for child support at this time. Instead, she wants legal custody of her son.
“I am the only parent to make decisions for R.S.C. I schedule and take him to all his medical appointments,” she argued in the docs.
“And I am the only parent who cares for him on a daily basis. I feed him, bathe him, and ensure that all his physical and emotional needs are met.”
St. Clair claims that Musk was not present during the birth of their child, despite having the opportunity to be there.
She also alleges that he has shown little interest in being involved in the child’s life.
According to her, Musk has only met their son three times, and he has never initiated contact regarding the child.
“Respondent has never asked to see our child on any other occasion, he has never communicated to me about our child without my prompting,
he has never asked for photos of our child or checked in after doctor’s appointments,” she added in the filing.
